About these terms

These terms apply to thurmanscale.com, which is run by Thurman Scale ("Thurman", "we", "us"). By using the site you agree to them. If you don't agree, please don't use the site. How we handle personal information is explained on our privacy page, which is part of these terms.

Product information

We work to keep specifications, capacities, dimensions, ratings, drawings and photos on this site accurate, but they are for general information. We improve our products, and details can change without notice. Photos may show optional equipment.

• Your quote and order documents decide. The configuration, capacity and specifications of your scale are the ones in your written quote and order confirmation.
• Installation manuals and drawings come first. Nothing on this site replaces the installation manual, the foundation drawings or the advice of a qualified engineer. Foundations must be designed for your site by an engineer licensed where the scale is installed.
• Certification is set by the certificate. Where we mention an NTEP Certificate of Conformance or a Measurement Canada approval, the certificate itself states what is approved. Legal-for-trade use also depends on correct installation and on inspection by the authority where the scale is used.

Quotes, prices and sales

This website does not sell products or show prices, and nothing on it is an offer to sell. Thurman scales are sold, installed and serviced through authorized Thurman distributors, who are independent businesses. The price and terms of any sale are in the quote and order documents for that sale. The product warranty is the written Thurman warranty provided with the product. Nothing on this website creates a warranty or changes one.

Documents you download

Manuals, bulletins, spec sheets and other documents on this site are copyright Thurman Scale. You may download, print and share them to evaluate, buy, install, operate or service Thurman equipment. Please don't change them, remove our notices, or sell them. Use the current version from this site: printed copies can go out of date.

Names and logos

The Thurman name and logo, and product names such as Diamondback and Falcon, are trademarks of Thurman Scale or its affiliates. You may use the names to refer accurately to our products, but not our logos, and not in a way that suggests we endorse you, without our written permission.

The distributor portal

The distributor portal is for authorized Thurman distributors only. If we give you access:

• Your account is for you alone. Don't share sign-in codes or let others use your access.
• Portal documents are confidential. Use them only to sell, install and service Thurman products, and don't share them outside your company.
• Tell us when someone at your company no longer needs access, so we can remove it.
• We may change or remove access at any time, for example when a person leaves your company or a distributor relationship ends.

If your company has a distributor agreement with Thurman and it says something different, the agreement applies.

Using the site properly

Please don't:

• try to get into parts of the site you aren't authorized to use, or test it for weaknesses without our written permission (to report a security problem, write to info@thurmanscale.com);
• overload the site, or copy it with automated tools in a way that affects other visitors;
• send malware, spam, or requests in someone else's name through our forms.

We may block traffic that does any of these things.

What you send us

Please give accurate information in our forms, so we can answer you. If you send us ideas or feedback, we may use them to improve our products and this site, with no obligation to you.

Links to other websites

The site links to other websites, including our distributors' sites. We don't control them and aren't responsible for their content or practices.

What we can and can't promise

We work to keep the site available and correct, but we provide it "as is". To the extent the law allows, we make no promise that it will always be available, error-free or up to date, and we are not liable for any indirect, incidental or consequential loss, including lost profits or data, that comes from using this website or relying on its content. This section is about the website only. It does not change any quote, sale or warranty.

Nothing in these terms limits a right you have by law that can't be limited by agreement, including consumer protection law where you live.

Law that applies

These terms are governed by the laws of the State of Kansas, and disputes about them go to the courts in Johnson County, Kansas, except where the law of your state or province requires otherwise.

Changes to these terms

We may update these terms. The date at the top shows when they last changed, and the version posted here is the one that applies.
